This is a legal agreement between you, the user of our system, and Crescent Ridge Publishing, Adam Rafferty, the owner of Hot-Response.com domain, website, and we server application programs, herinafter referred to as "Company".

Use of any number of accounts through Hot-Response.com is referred to as the "Service". By signing up for and/or ordering a free or pro account means that you are agreeing to all of the terms and conditions set forth below.

The Service consists of a Hot-Responder TM autoresponder account assigned to an e-mail address of domain hot-response.com. You can login to your account via our User Login link, and modify your account settings and outbound messages through our User Control Panel.

Company exercises no control over the information which is entered by users passing through its servers.

DESCRIPTION OF USERS RESPONSIBILITIES

You, the user of the Service, are solely responsible for the information you enter into our system and the activities you perform while you use our Service.

All paying users are entitled to our 30 money back guarantee. If you are for any reason dissatisfied with the Service within 30 days, Company or a Sales Associate will send you a refund check.

You may not distribute your password, you may not attempt to discover another users password, you may not let others log in through your account, and you may not attempt in any way, shape or form to access our servers except through the website and the forms on the site.

DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITIES, INDEMNIFICATION

Company does not warrant, promise or guarantee that the service will be free of errors or interruptions.

The Service is offered and distributed on an "As Is" basis. There are no warranties or Guarantees of any kind whatsoever expressed, implied, or otherwise except for our 30-day money back guarantee.

Company will not be responsible in any capacity for any damages, losses, fees, fines, or costs that you, or your business, or your associates may suffer while you are using our service and have an active account.

You agree 100% to idemnify and hold harmless Company from any claims resulting from your using this service.

You agree without question that use of the Service is entirely at your own risk. Neither Company nor its service providers, agents, affiliates, licensors, employees, programmers, designers, or anyone else affiliated with Company shall have any liability for any damages suffered by you or any other party as a result of your or anyone else's using or misusing the service.

ABOUT USAGE OF THE SERVICE

You may not send any unsolicited emails whatsoever either using our service or through any other mail server or service through which you advertise or mention Hot-Response.com, Company, or any of its employees or agents. You may not use bulk mailing services to do mailings in which the messages mention Hot-Response.com, Company, or any of its employees or agents.

Such action will result in a swift and immediate termination of your account, and you will be charged a $1000 cleanup fee, and you will be subject to legal action. Your isp will be contacted by us or our lawyers as well, and your current ISP account could be terminated as well.

The Service may be used for lawful purposes only. Transmission or storage of pornography, child pornography, and sex-related content and merchandising and/or any material in violation of any international, federal or any state law or regulation is expressly prohibited.

You may not use the Service in conjunction with a FFA (free for all links page), or Usenet Newsgroup Postings, or any similar concept.

You agree not to provide false or misleading information on any of the Services sign up pages, as well as on your Settings page.

You agree to provide a valid email address for the FROM: and REPLY-TO fields on your settings page so that recipients of your follow ups may contact you legitimately.

You agree to receive emails from our servers once you sign up for a FREE trial of the service or a PRO version of the service. Your email address will never be shared with a 3rd party.

You agree to never accuse Company, Hot-Response.com or any of it's employees, agents, affiliates or otherwise of sending you SPAM (Unsolicited Email) since you have willfully signed up and have agreed to receive email messages.

If you wish to no longer receive mail from Crescent Ridge Publihing orHot-Response. com, you may terminate your account to do so.

Accounts are terminated (including but not limited to your database of addresses, follow ups, settings, orders information) if payment is not received within 20 days of the sending of your invoice.

Crescent Ridge Publishing reserves the right to suspend or terminate service without prior notification, at any time, for any reason it deems necessary.

Accounts may be terminated at any time by sending an email to Company in which the Users First Name, Last Name, account Username, and Order Number are provided. No partial refunds will be issued for time remaining in account. Termination will take effect after confirmation from Company confirms the request.

Crescent Ridge Publishing reserves the right to change prices or free offers for any of its products or services, at any time, for any reason.

These terms and conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted.
